The IRA currently incentivizes payment of prevailing wages and compliance with an apprentice utilization formula by providing taxpayers with a fivefold increase in tax credits or deductions on covered energy projects. In June 2024, the Treasury and the IRS adopted regulations which implement the IRA’s labor provisions.

SMART and SMACNA will present an overview of the newly-adopted regulations, which incentivize the use of project labor agreements to achieve compliance with prevailing wage and apprenticeship utilization requirements and details the steps that signatory and open shop contractors must take to satisfy the “good faith efforts” requirement to utilize apprentices in accordance with the criteria set forth in the IRA.
